2. Your Information and the Blockchain

Blockchain technology, also known as distributed ledger technology (or simply ‘DLT’), is at the core of our business. Blockchains are decentralized and made up of digitally recorded data in a chain of packages called ‘blocks’. The manner in which these blocks are linked is chronological, meaning that the data is very difficult to alter once recorded. Since the ledger may be distributed all over the world (across several ‘nodes’ which usually replicate the ledger) this means there is no single person making decisions or otherwise administering the system (such as an operator of a cloud computing system), and that there is no centralized place where it is located either.

Accordingly, by design, a blockchains records cannot be changed or deleted and is said to be ‘immutable’. This may affect your ability to exercise your rights such as your right to erasure (‘right to be forgotten’), or your rights to object or restrict processing, of your personal data. Data on the blockchain cannot be erased and cannot be changed. Although smart contracts may be used to revoke certain access rights, and some content may be made invisible to others, it is not deleted.

In certain circumstances, in order to comply with our contractual obligations to you (such as delivery of tokens) it will be necessary to write certain personal data, such as your CirclesAddress or other cryptocurrency wallet address, onto the blockchain; this is done through a smart contract and requires you to execute such transactions using your wallet’s private key.

In most cases ultimate decisions to (i) transact on the blockchain using your CirclesAddress or other cryptocurrency wallet address, as well as (ii) share the public key relating to your Ethereum or other cryptocurrency wallet address with anyone (including us) rests with you.

3. How We Use Personal Data

3.1 When visiting our website

We may collect and process Personal Data about your use of our website. This data may include:

3.2 When subscribing to our Newsletter

We may collect and process the Personal Data that you provide to us for the purpose of subscribing to our email newsletter (Circles Newsletter). This data may include:

  2. the date and time of registration;
  3. your IP address.

This data is collected and processed for the purpose of sending you our newsletter.

The legal basis for this processing is your consent as provided in the opt-in confirmation part of our newsletter sign-up process.

Your email address will be stored as long we have the consent to send you a newsletter.

3.3 When receiving our Newsletter

If you have subscribed to our newsletter, each time you receive a newsletter from us, we may collect and process Personal Data. This data may include:

  1. the date and time you opened the email;
  2. what (if any) links or URLs you accessed from our newsletter;
  3. the location it was accessed from

This data is collected and processed for the purpose of improving the content of our newsletter. The legal basis for this processing is your consent as provided in the opt-in confirmation part of our newsletter sign-up process.

3.4 When participating in your CirclesUBI Token creation

When participating in your CirclesUBI creation we may collect and process personal data. The data will be stored in different instances.

a) On the xDai blockchain following data will be stored:

  1. your wallet address;
  2. your wallet owner address
  3. the amount of generated CirclesUBI Token
  4. time of when your CirclesUBI Token has been created
  5. your transaction metadata such as transaction hash, date and blocknumbers
  6. your complete friend and trust network of people your are connected with

The data is used and processed in order to credit the user the right amount of CirclesUBI tokens pursuant to the terms of use of the CirclesHub smart contract.

Data stored on the blockchain and is irrevocable and append only, publicly indexed and searchable by all users on our platform, any searchengine or any other third party through our API and blockchain gateways including external blockchain service providers.  

The legal basis for this processing is that it is necessary to fulfil a contract with you.

THE DATA WILL BE STORED ON THE XDAI BLOCKCHAIN. GIVEN THE TECHNOLOGICAL DESIGN OF THE BLOCKCHAIN, AS EXPLAINED IN SECTION 2, THIS DATA WILL BECOME PUBLIC AND IT WILL NOT LIKELY BE POSSIBLE TO DELETE OR CHANGE THE DATA AT ANY GIVEN TIME.

b) In our Digital Ocean Webserver we will store the following data:

  1. your email address (private)
  2. your wallet address (public);
  3. your wallet owner address (public);
  4. the amount of generated CirclesUBI Token (public)
  5. time of when your CirclesUBI Token has been created (public)
  6. your first name or anonymized username (public);
  7. your last name (public but optional);
  8. your country of residence (public but optional);
  9. your profile image (public but optional);
  10. your passions described in one sentence (public but optional)
  11. your transaction metadata such as transaction id, sender address, receiver address, amount, date, blocknumber, transitiv payment path, payload and transfer messages (public);
  12. your complete friend and trust network of people your are connected with (public)
  13. your IP address (private)

This data is collected and processed for the purposes to track the success of the marketing campaigns, for user demographics in order to identify target markets and for the purpose of improving our products and services.

Data that is marked as "private" is only accessable to those that are authorised to process your data. We work hard to ensure our staff and volunteers can only see and access the data they need to perform their tasks. All our staff are trained to understand data protection and what they need to do to keep your data secure.

Data that is marked as "public but optional" is publicly indexed and searchable by all users on our platform, any searchengine or any other third party through our API. By providing us with this optional data you consent to us publishing it to the public. To revoke your consent, you can always change or delete "public but optional data" and we will delete it from our database.

DATA THAT IS MARKED AS PUBLIC IS STORED ON THE XDAI BLOCKCHAIN. GIVEN THE TECHNOLOGICAL DESIGN OF THE BLOCKCHAIN, AS EXPLAINED IN SECTION 2, THIS DATA WILL BECOME PUBLIC AND IT WILL NOT LIKELY BE POSSIBLE TO DELETE OR CHANGE THE DATA AT ANY GIVEN TIME. PUBLIC DATA IS INDEXED AND SEARCHABLE BY ALL USERS ON OUR  PLATFORM, ANY SEARCHENGINE OR ANY OTHER THIRD PARTY THROUGH OUR API AND BLOCKCHAIN GATEWAYS, INCLUDING EXTERNAL BLOCKCHAIN SERVICE PROVIDERS.

3.5 When visiting our Twitter, Vimeo, Discord Chat or Instagram

We may collect and process Personal Data about your use of our Twitter, Vimeo, Discord Chat or Instagram. This data may include:

  1. clicks on a shortened URL;
  2. a history of referral URLs for clicks of a shortened URL; and
  3. a history of IP addresses used to access a shortened URL.

This data is collected and processed for the purposes to track the success of the marketing campaigns, blog posts, and other marketing material; and for user demographics in order to identify target markets. This data is collected and processed for the purpose of improving the content of our shared links pursuant to our legitimate interests. 3.6 Creating and deploying a MultiSig and making transactions

When creating and deploying a MultiSig to the blockchaian and making transactions we may collect and process personal data. This data includes:

  1. your wallet address;
  2. smart contract address;
  3. transaction data (transaction id, sender address, receiver address, amount and payload);
  4. wallet addresses of potential other owners of your MultiSig;
  5. amount and type of funds stored on your wallet address as well as the smart contract

This is necessary in order to ensure usability, trust and security of multi-signature transaction and transactions on the xDai blockchain and in general.

Furthermore, wallet addresses, smart contract addresses and transaction data may be stored locally inside the local storage of the web browser or within the standalone application. This is necessary to provide for a user friendly and transparent user interface and experience.

This data may be processed, in order to deliver the functionality of the product. The legal basis for this processing is your consent, provided by the active submission of the wallet address.

We may process any of your Personal Data where it is necessary to establish, exercise, or defend legal claims. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

4. Use of Third Party Applications

4.1 Mailgun

We use Mailgun to send out newsletters to subscribers. Mailgun allows us to prepare customized Emails and manage our subscribers.

4.5 xDai Blockchain

When participating in the CirclesUBI creation process, your wallet address, the amount of Circles, and the time of creation will be stored on the xDai blockchain. See section 2 of this Policy.

THE INFORMATION WILL BE DISPLAYED PERMANENTLY AND PUBLIC, THIS IS PART OF THE NATURE OF THE BLOCKCHAIN. IF YOU ARE NEW TO THIS FIELD, WE HIGHLY RECOMMEND INFORMING YOURSELF ABOUT THE BLOCKCHAIN TECHNOLOGY BEFORE USING OUR SERVICES.

4.6 Support Channels

In order to provide user support we will use different channels like Telegram, Discord Chat and Email to facilitate the resolution of any questions and concerns should these arise. By accepting this Privacy Policy, you are deemed to consent to providing the following Personal Data to persons looking to resolve any dispute:

  1. Name and surname
  2. Used wallet address;
  3. Detailed enquiry description;
  4. The date and time that the issue arose;
  5. The outcome sought.

5. Sharing Your Personal Data

We may pass your information to our Business Partners, administration centers, third party service providers, agents, subcontractors and other associated organisations for the purposes of completing tasks and providing our services to you. 7. Existence of Automated Decision-Making

We do not use automatic decision-making or profiling when processing Personal Data.

8. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

IN THESE CIRCUMSTANCES WE WILL ONLY BE ABLE TO ENSURE THAT ALL PERSONAL DATA THAT IS HELD BY US IS PERMANENTLY DELETED.

We will proceed to comply with an erasure request without delay unless continued retention is necessary for:

  • Exercising the right of freedom of expression and information;
  • Complying with a legal obligation under EU or other applicable law;

IN THESE CIRCUMSTANCES WE WILL USE OUR REASONABLE ENDEAVOURS TO ENSURE THAT ALL PROCESSING OF PERSONAL DATA HELD BY US IS RESTRICTED, NOTWITHSTANDING THIS, YOUR RIGHT TO RESTRICT TO PROCESSING MAY NOT BE ABLE TO BE FULLY ENFORCED.
